A slip and fall is a kind of negligence claim. There are about eight million emergency room visits each year because offalls. Of those falls, approximately 12 percent are slip and fall accidents.To have a negligence claim, you must live up to all of the elements of the claim. One of the elements is restitution. Without injuries, you haven’t met all of the steps to take forward a claim. As the saying says- no harm, no foul.   

Inslip and fall injuries, the property owner may argue that the plaintiff ispartially or totally accountable for the accident that led to the injuries. This kind of argument is made under a legal conception called as "comparative fault," and states have codified the concept in "comparative negligence" and "contributory negligence" lawsuit.
